Terms of Service

1. Acceptance of Terms

By accessing or using ConsentForge ("the Service") operated by ConsentForge GmbH ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

ConsentForge provides a consent management platform that enables websites to collect, manage, and document user consent in accordance with the General Data Protection Regulation (GDPR) and related data protection laws. The Service includes a banner builder, script blocking engine, vendor library, evidence layer, and distribution tools.

3. Account Registration

To use the Service, you must register for an account. You agree to provide accurate, current, and complete information and to keep your account credentials confidential. Accounts are subject to approval. We reserve the right to reject or terminate accounts at our discretion.

4. Acceptable Use

You may not use the Service for any unlawful purpose, to violate any person's privacy rights, to transmit spam or malicious code, or to interfere with the proper working of the Service.

5. Payment and Billing

Paid plans are billed in advance on a monthly or annual basis. All fees are exclusive of VAT unless stated otherwise. No refunds are provided for partial months of service.

6. Data Processing

By using the Service, you appoint ConsentForge GmbH as a data processor under Article 28 GDPR. A Data Processing Agreement (DPA) is available upon request and is incorporated by reference into these Terms.

7. Intellectual Property

The Service and all associated materials are the intellectual property of ConsentForge GmbH. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our express written permission.

8. Limitation of Liability

To the maximum extent permitted by law, ConsentForge GmbH shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service. Our total aggregate liability shall not exceed the fees paid by you in the 12 months preceding the claim.

9. Governing Law

These Terms are governed by the laws of the European Union and the country in which ConsentForge GmbH is incorporated. Any disputes shall be resolved in the courts of that jurisdiction.

10. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 30 days before they take effect. Continued use of the Service constitutes acceptance of the revised Terms.
